Terms & Conditions

1. Conditions of Use

1.1 These Terms and Conditions apply once a lesson, test or service is booked with SafePass Driving School ("SafePass", "we", "us", "our").

1.2 SafePass may update these Terms and Conditions from time to time. SafePass reserves the right to change and/or add these terms and conditions at any time without prior notice. The most current version will apply to all bookings.

1.3 By booking or participating in any SafePass service, you agree to these Terms and Conditions.

2. Booking and Payment

2.1 Lessons and tests are subject to availability and must be booked in advance.

2.2 Full payment is required at the time of booking unless otherwise agreed in writing.

2.3 Bookings may be made via phone, message, or online platforms where available.

2.4 A booking is confirmed once payment has been received and confirmation is provided by SafePass.

2.5 In the interest of road safety, a no-phones policy applies during all driving lessons. Any booking or enquiries, please leave a message or send a text, and we will respond as soon as possible.

3. Lessons

3.1 Lessons commence and conclude at the agreed pick-up and drop-off location specified at the time of booking.

3.2 Lesson time includes briefing and debriefing.

3.3 An instructor may terminate a lesson immediately if the learner:

  • breaches these Terms and Conditions;
  • behaves recklessly or dangerously;
  • fails to follow instructor directions;
  • breaches licence conditions or road rules;
  • engages in unsafe, unlawful, or abusive behaviour;
  • is considered unfit or unsafe to drive.

4. Learner Driver Obligations

4.1 Learners must:

  • carry a valid Australian learner’s permit, driver’s licence, or recognised overseas licence;
  • comply with all licence conditions and road rules;
  • follow instructor instructions;
  • act safely and responsibly;
  • arrive on time;
  • wear appropriate footwear;
  • not use mobile phones while driving;
  • not eat or drink during lessons;
  • treat instructors respectfully.

5. Vehicle on Road Test (VORT)

5.1 SafePass may assist with VORT preparation and booking where permitted.

5.2 All VORTs are conducted in accordance with South Australian government requirements, including:

  • the examiner must not be the learner’s instructor;
  • serious road rule breaches may result in immediate failure;
  • required manoeuvres and minimum scores must be achieved;
  • learners are responsible for observing mandatory waiting periods after a failed test.

5.3 If you select a VORT test only service, a processing fee of $30 will be applied. SafePass Driving School will arrange the VORT with an examiner who is independent of SafePass. SafePass is not responsible for any payment transactions or the outcome of the test.

The examiner’s name and contact details can be provided so you may contact them directly regarding payment, test results, or related enquiries. Any complaints regarding the VORT must be directed to the Department for Infrastructure and Transport (DIT) and not to SafePass Driving School.

6. Cancellation and Rescheduling

6.1 Lesson cancellations:

  • More than 24 hours’ notice: no charge or credit issued.
  • Less than 24 hours’ notice or no-show: full lesson fee charged.

6.2 Test (VORT) cancellations will be charged in full.

6.3 SafePass may refuse or cancel a lesson if a learner is unfit to drive or suspected to be under the influence of drugs or alcohol.

6.4 SafePass may reschedule lessons or tests with reasonable notice due to illness, vehicle issues, weather, traffic conditions, or other unforeseen circumstances.

6.5 Any cancellation fees must be paid before booking or attending further lessons. All fees include GST where applicable. If a lesson is funded by an agency or organisation, the cancellation fee will be billed to the funding body.

7. Refunds

7.1 Refund requests must be made within a reasonable time of purchase.

7.2 Approved refunds are issued to the original payer using the original payment method.

7.3 No refunds apply for late cancellations or non-attendance.

7.4 Refunds are not available for Vehicle On-Road Test (VORT) once it is booked and confirmed, as SafePass does not get any refunds from DIT (Department for Infrastructure and Transport) once booked.

8. Liability

8.1 Learners are responsible for:

  • government and test-related fees;
  • traffic infringements incurred during lessons;
  • insurance excess for damage caused;
  • cleaning fees (up to $150) if required due to learner actions;
  • damage beyond normal wear and tear not covered by insurance.

8.2 Where SafePass pays costs on behalf of a learner, the learner agrees to reimburse SafePass upon request.

8.3 SafePass is not liable for indirect or consequential loss except where required by law.

9. Disclaimers

9.1 SafePass provides lessons with due care and skill in accordance with applicable laws.

9.2 All instructors hold a valid South Australian Motor Driving Instructor licence.

9.3 SafePass does not guarantee:

  • licence or test outcomes;
  • learner competency after any number of lessons.

9.4 SafePass recommends a minimum of 8–10 hours of professional training to adequately prepare for the VORT. If a student chooses to undertake only 1–3 hours of training prior to the VORT, SafePass accepts no responsibility for the outcome or result of the test.

10. Australian Consumer Law

Nothing in these Terms and Conditions excludes, restricts or modifies any rights you may have under the Australian Consumer Law.
